FISCAL ANALYSIS



ASSUMPTION



Officials from the Department of Corrections assume the proposed legislation would have no fiscal impact on their agency.



Officials from the Department of Health and Senior Services (DOH) assume the Department of Corrections (DOC) would pay for all of the testing described under this bill. However, DOH assumes the DOC may significantly increase testing for hepatitis B and C which would result in more reports of disease to the DHSS. These reports would require follow-up by a ½ FTE Health Program Representative I (each at $30,204 per year) to coordinate with DOC and the local public health agency appropriate treatment and investigation. This FTE would coordinate follow-up on all disease reports from the DOC. Also, the FTE would produce disease reports to assist DOH and DOC in identifying trends in diseases among offenders. The DOH estimates the cost of the proposal to be $31,355 in FY 04; $29,530 in FY 05; and $30,305 in FY 06.



Oversight assumes the DOH could experience an increase in reports due to the proposed legislation. Oversight assumes the DOH could absorb the cost of the increased case load within existing resources. If the DOH experiences an increase that would justify additional FTE, the DOH could request funding through the appropriation process.

FISCAL IMPACT - Small Business



No direct fiscal impact to small businesses would be expected as a result of this proposal.





DESCRIPTION



The proposed legislation would require the Department of Corrections to conduct tests for tuberculosis on all offenders prior to their delivery to and release from all correctional facilities. The proposal would deny any right for offenders to refuse testing for infectious diseases while in the custody of the department.



This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
