FISCAL ANALYSIS


ASSUMPTION


Officials from the Department of Natural Resources (DNR) assume the council would establish fees in an amount to cover resources necessary to carry out the dam safety inspections. Since this proposal does not indicate a specific fund for the receipt of the fees established by the council, the department assumed the receipts would be deposited into the general revenue fund and payments for the resources used to carry out the legislation would also be from the general revenue fund.


The department estimates there are 220 high and significant hazard dams under the definition of dams in the proposed legislation. The department assumed that less than 10 of 220 high and significant dams would request an agricultural exemption and would elect not to be regulated by the council. Therefore, the department would inspect approximately 210 dams.


Under this proposal the department would be inspecting fewer dams; however, the department assumed existing resources would be used to perform the annual inspections, administer the agricultural exemption program to verify the exemptions and periodically determine if the exemptions are still valid. The proposal would also make resources available to develop the inundation zones for all regulated dams, which is in the existing law.
