ASSUMPTION


Officials from the Department of Public Safety, Capitol Police, Missouri Highway Patrol, State Water Patrol, Department of Mental Health, Department of Elementary and Secondary Education, Department of Health and Senior Services, Department of Higher Education, Department of Insurance, Financial Institutions and Professional Registration, Department of Labor and Industrial Relations, State Auditor's Office, Department of Economic Development, Office of State Courts Administrator, State Treasurer's Office, Department of Revenue, MoDOT and Patrol Employees Retirement System, Department of Conservation, Missouri Consolidated Health Care Plan, Missouri Gaming Commission, Office of the Lieutenant Governor, Missouri Ethics Commission, Certificate of Need Program, Department of Agriculture, Division of Fire Safety, Joint Committee on Public Employee Retirement, State Public Defender, Administrative Hearing Commission, Missouri Veteran's Commission, Division of Budget and Planning and State Tax Commission assume no fiscal impact to their agency.


Officials from the Secretary of State's Office assume most joint resolutions are considered by the General Assembly that would require the Secretary of State's office to pay for publishing in local newspapers the full text of each statewide ballot measure as directed by Article XII, Section 2(b) of the Missouri Constitution and Section 116.230-116.290, RSMo. The Secretary of State's office is provided with core funding to handle a certain amount of normal activity resulting from each year's legislative session. Funding for this item is adjusted each year depending upon the election cycle with $1.6 million historically appropriated in even numbered fiscal years and $100,000 appropriated in odd numbered fiscal years to meet these requirements. The appropriation has historically been an estimated appropriation because the final cost is dependent upon the number of ballot measures approved by the General Assembly and the initiative petitions certified for the ballot. In FY 2007, at the August and November elections, there were 6 statewide Constitutional Amendments or ballot propositions that cost $1.2 million to publish (an average of $193,000 per issue). Therefore, the Secretary of State's Office assumes, for the purposes of this fiscal note, that it should have the full appropriation authority it needs to meet the publishing requirements. However, because these requirements are mandatory, we reserve the right to requires funding to meet the cost of our publishing requirements if the Governor and the General Assembly change the amount or eliminate the estimated nature of our appropriation.


Officials from the Department of Natural Resources (DNR) assume the level of effort that would be involved in the two-year budgets would initially be more than preparing a budget for one year. It is unknown what the level of effort would be responding to hearings, investigations,

examinations and in-depth reviews for the general assembly in the off year of the budget cycle. The DNR assumes the proposal would be implemented within existing resources.


Officials from the Missouri House of Representatives assume the fiscal impact (savings) is out of the time frame provided in a fiscal note. The estimated savings for members, had the proposal been in effect for the current session would be as follows:

            mileage                                               $ 2,511.60 ($.455 x 276 ave. roundtrip mileage x

Total savings would be $68,525.60 per member x 26 members = $1,774,567.60.


Oversight assumes there could be additional savings for House administrative staff, printing costs, and telecommunications and data processing expenses. There also could be costs for capital improvements (e.g. reconfiguring office space in the Capitol).
