FISCAL ANALYSIS
ASSUMPTION
Officials from the Department of Public Safety - Missouri Highway Patrol (MHP) state the proposed legislation would require, subject to appropriation, that retired patrol members be paid a per diem mileage and travel expenses when testifying in a court proceeding at least thirty miles from their residence.
The MHP assumes an unknown - under $100,000 fiscal impact from this proposed legislation. The MHP does not currently track, nor have a way to track how many retired employees perform as witnesses in official court proceedings.
The MHP assumes the new appropriation will be from General Revenue funds because in many cases, court appearances after retirement involve the Division of Drug and Crime Control. Court appearances also involve Crime Laboratory personnel in which the appropriation would be from both General Revenue and Highway Funds and at other times, cases will involve an accident reconstructionist or other highway traffic issue, in which case the appropriation would be from Highway funds.
Officials from the Department of Public Safety - Director’s Office assume the proposal would not fiscally impact their agency.
Oversight will assume the appropriation will be from the Highway Funds.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
FISCAL DESCRIPTION
Subject to appropriation, this bill establishes a per diem and a mileage and travel reimbursement for a retired State Highway Patrol officer who is required to be a witness in an official court proceeding more than 30 miles from his or her residence. Currently, retired officers are not reimbursed for any expenses incurred as a result of testimony required in trials that extend beyond their retirement date.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
