FISCAL ANALYSIS


ASSUMPTION


Officials from the Department of Public Safety – Director’s Office, – Missouri State Highway Patrol, and the Boone County Sheriff’s Department assume the proposal would have no fiscal impact on their agencies.


Officials from the Department of Social Services assume there is no fiscal impact to the Division of Youth Services (DYS). DYS is not generally involved when a child is initially detained. The person doing the “detaining” would normally be a law enforcement officer (policeman, sheriff, etc.) or a local juvenile officer. Only after the child has been adjudicated by the court as delinquent is the child placed into the custody of the Division of Youth Services. Therefore, it is reasonable to assume that a child in DYS custody would have already been reported to ICE by the proper authorities at the point of first contact. DYS currently reports any juvenile believed to be an illegal alien to proper authorities. DYS states they report approximately 10 to 12 such juveniles per year.


Officials from the Springfield Police Department assume the proposal would result in increased costs to the department due to the additional time for officers to try to contact Immigration Authorities. Officials estimate the cost to be $1,000 annually.


Oversight assumes local law enforcement agencies would incur additional administrative costs for contacting Immigration and Customs Enforcement. Oversight assumes the statewide cost would not exceed $100,000 per fiscal year.


Oversight assumes juveniles believed to be illegal aliens would be detained in local juvenile detention/attention centers until they are turned over to Immigration and Customs Enforcement. Oversight assumes these local juvenile centers could incur increased costs for housing suspected juvenile illegal aliens. Oversight assumes the statewide cost would not exceed $100,000 per fiscal year.


Officials from the Greene County Sheriff’s Department, Jackson County Sheriff’s Department, St. Louis County Police Department, Columbia Police Department, Kansas City Police Department, and the St. Louis Metropolitan Police Department did not respond to Oversight’s request for fiscal impact.

FISCAL IMPACT - Small Business


No direct fiscal impact to small businesses would be expected as a result of this proposal.



FISCAL DESCRIPTION


The proposal requires that whenever there is probable cause to believe that a juvenile, who is detained for a violation that would be a felony if committed by an adult, is an illegal alien, the juvenile must be reported to the United States Immigration and Customs Enforcement.


This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
