FISCAL ANALYSIS


ASSUMPTION


Officials from the Department of Transportation assume the proposal would not fiscally impact their agency.


Officials from the Department of Public Safety - Missouri Highway Patrol (MHP) state the proposed legislation would require the conversion of current commercial vehicle officers (CVOs) to peace officers by July 1, 2015. The MHP assumes the training would be scheduled over a 4-year period (FY ‘09 through FY ‘12). In FY ‘13, there would no longer be any fiscal impact.


The Academy normally gets reimbursed from Commercial Vehicle Enforcement (CVE) for the cost of providing training at a rate of $55 per day per student. The 600 hours mandated by this legislation would be the equivalent of 15 weeks of training (600 hours / 40 hours per week = 15 weeks). This would mean a cost of $4,125 per student for the 15 weeks of training ($55 per day x 15 weeks x 5 days per week = $4,125). The total cost would be $140,250 in FY09 (34 students x $4,125 per student = $140,250).


To pay for this training, the Academy bills the CVE Division, and money is transferred from the Highway fund to the Highway Patrol Academy fund.


NOTE: If it's not possible to schedule this training within a 4-year period, the next most likely scenario would be to spread it over the full 7 years (FY ‘09 thru FY ‘15), which would lessen the cost each year by spreading it over a longer period.


Also, this bill would require newly hired CVOs to extend their training from the current 12 weeks to a minimum of 21 weeks in order to complete the 600 hour POST curriculum and specialized training. The extra 9 weeks of training will have an impact on the Academy and CVE as far as housing, meals, and classroom space costs. There is no way to estimate how many new CVOs will be trained in the near future, so this additional cost cannot be estimated; however, it will be $2,475 per student ($55 per day x 9 weeks x 5 days per week = $2,475).


In response to a similar proposal from 2007 (HB 341), the MHP stated currently, the CVO’s train for 12 weeks. However, these 12 weeks of training would not count towards the 600 hour POST requirement because most of the classes are not POST approved classes from the 600 hour curriculum, nor were the classes instructed by POST approved instructors. For training to count as part of the Class A 600 hour certification, the classes have to come from the POST approved 600 hour curriculum and the lesson plans be approved and "sealed" by POST before the classes are taught.


ASSUMPTION (continued)


All classes taught have to be taught by POST approved instructors. Approximately half of the classes taught to CVO's are required to meet federal standards for commercial vehicle enforcement officers, not a certified police officer. Examples: The North American Standards Part A and Part B (80 hours), Basic Hazardous Materials (40 hours), Cargo Tank (40 hours) are not POST approved courses and are not part of the 600 hour curriculum. Many of the other classes taught to the CVO's are from an abbreviated POST approved lesson but do not contain the required number of hours and objectives for that class to count towards the POST requirement.


Therefore, the MHP estimates the following fiscal impact:

 

FY 2009          $140,250 ($4,125 x 34 officers);

FY 2010          $144,458 ($4,125 x 34 officers at 3% inflation);

FY 2011          $148,791 ($4,125 x 34 officers at 3% inflation); and

FY 2012          $148,748 ($4,125 x 33 officers at 3% inflation)

 

In response to HB 341 in 2007, the MHP assumed the extra cost would be incurred in the General Revenue Fund; however, this year the MHP assumes the Highway Fund will reimburse the Highway Patrol Academy Fund. Oversight will assume the Highway Patrol Academy fund will incur additional expenses from training the pool of CVO’s. Oversight also assumes the transfer in from the Highway Funds and the increase in expenses from the training would net to zero.

FISCAL DESCRIPTION


This proposal requires commercial vehicle enforcement officers to meet the mandatory standards for basic training and licensure of peace officers. Officers who are employed and performing their duties on August 28, 2008, will have until July 1, 2015, to comply with the mandatory standards.


This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
