FISCAL ANALYSIS


ASSUMPTION


Officials from the Department of Transportation, Department of Corrections, Department of Public Safety – Director’s Office, and the – Missouri State Highway Patrol assume the proposal would have no fiscal impact on their agencies.


Officials from the Office of State Courts Administrator assume the proposed legislation would have no fiscal impact on the courts.


Officials from the Department of Revenue (DOR) assume this proposal establishes offenses of “operation of a vehicle causing injury” for a 90- day suspension, “operation of a vehicle causing serious injury” for a 6-month suspension, and “operation of a vehicle causing death” for a 1 year suspension. This will be on any traffic offense the person is found guilty of or pleas guilty to, besides causing injury, serious injury, or death to a person. This will be a court order issued by the court convicting the person.


DOR assumes they will incur administrative impact because they will:

 

          Receive a court order advising this department to take action against the person.

 

          Need to process the court order to suspend the driving privilege by, evaluation, and key entry of the order. This process will be absorbed by current staff.

 

          Need to test any programming associated with the court order for injury, serious injury, or death. This will be absorbed through the daily activities.


DOR assumes the following Office of Administration – Information Technology Services Division (OA–ITSD) costs:


DOR provided the following OA–ITSD estimates: This legislation could be implemented utilizing 2 existing CITs III for 3 months at a rate of $ 25,116. OA–ITSD estimates this can be accomplished within existing resources; however; if priorities shift, additional FTE/overtime would be needed to implement the proposal.




ASSUMPTION (continued)


Officials from the Office of the State Public Defender (SPD) assume increasing penalties on existing crimes, or creating new crimes, will require more SPD resources. While the number of new cases (or cases with increased penalties) may be too few or uncertain to request additional appropriations for this specific bill, the SPD will continue to request sufficient appropriations to provide competent and effective representation in all its cases.


Oversight assumes the Office of the State Public Defender (SPD) could absorb the costs of the proposed legislation within existing resources. Oversight assumes any significant increase in the workload of the SPD would be reflected in future budget requests.


Officials from the Office of Prosecution Services did not respond to Oversight’s request for fiscal impact.
