FISCAL ANALYSIS


ASSUMPTION


Officials from the Department of Public Safety - Office of the Director and the Missouri State Highway Patrol, the Department of Social Services, and the Department of Health and Senior Services state there would be no fiscal impact to their respective agencies resulting from this proposed legislation.


Officials from the Office of Secretary of State (SOS) assume many bills considered by the General Assembly include provisions allowing or requiring agencies to submit rules and regulations to implement the act. The SOS is provided with core funding to handle a certain amount of normal activity resulting from each years legislative session. The fiscal impact to the SOS office for Administrative Rules for this proposal is less than $2,500. The SOS recognizes this is a small amount and does not expect additional funding would be required to meet these costs. However, SOS also recognizes that many such bills may be passed in a given year and that collectively the costs may be in excess of what the SOS can sustain with their core budget. Any additional required funding would be handled through the budget process.


Officials from the Department of Revenue (DOR) state their agency will be required to purchase a fingerprint scanning device to capture a set of applicant prints. DOR assumes the fingerprints will be sent to the Missouri State Highway Patrol for storage in their current fingerprint data base just as other applicant prints are stored today. DOR assumes this proposal will require their agency to modify the current license issuance system and supporting applications to no longer require an image to be collected for religious objectors.


DOR is basing this analysis on the determination they will offer this fingerprint collection process only in the central office as they do today for an applicant applying for a document without a photograph. If the intent of the proposal is to have this available in all contract offices, the fiscal impact for equipment and implementation in approximately 180 contract offices will greatly increase.


DOR and Office of Administration - Information Technology Services Division is basing the fiscal impact analysis on the assumption that the language of the proposal will be modified to have the fingerprint data stored at the Missouri State Highway Patrol to utilize existing database versus developing a new storage process for this limited number of applicants.


DOR will be required to set up a new fingerprint collection system and develop required interfaces with the Missouri State Highway Patrol. Modifications to current religious objector applications, web information, and procedures must also be completed due to the additional ASSUMPTION (continued)


documentation required under this proposed legislation.


This proposed legislation will require programming changes to the Missouri Electronic Driver License (MEDL also referred to as Over The Counter-OTC) software and supporting applications. These programming changes will need to be designed and tested.

Oversight assumes the programming costs can be absorbed with existing resources.


DOR will be required to purchase a fingerprint scanning device to capture a set of applicant prints:

Estimated Cost for fingerprint collection training for central office staff       $500

Since legislation changes in 2004 (HB 928, HB 1123, HB 1280), there have been 562 documents issued to religious objectors. This would be an estimated 161 applicants annually.


DOR will collect and have the fingerprints stored, but unless DOR or law enforcement collects prints again or submits them for criminal activity there is not a current process in place to retrieve this information for identity only purposes at the time of stop or application for a duplicate or renewal license. There will be no additional personnel costs to collect and store the fingerprints. Assuming funding is appropriated for the system and ongoing maintenance, DOR will not charge the applicants a fingerprint fee.


Officials from the Boone County Sheriff's Department stated there would be no fiscal impact to their agency as a result of this proposal.

No direct fiscal impact to small businesses would be expected as a result of this proposal.


FISCAL DESCRIPTION


This proposed legislation allows certain individuals who have religious objections to having their photograph taken and maintained by the Department of Revenue to receive a driver's license or

nondriver's license without a photograph if the applicant:


(1) Complies with existing requirements;


(2) Submits a set of fingerprints and pays a fee for the cost of

processing the prints; and


(3) Presents evidence to the department director that he or she is exempt from paying Social Security and Medicare taxes because of his or her affiliation with a recognized religious group that existed continuously since December 31, 1950, conscientiously opposes accepting certain public and private insurance benefits, and provides a reasonable level of living for its dependent

members.
